DESIWAY - REFUND POLICY

IMPORTANT NOTICE

This Refund Policy is an Additional Terms document that supplements and forms part of the DesiWay Master Terms and Conditions. By purchasing any paid service on DesiWay, you agree to both the Master Terms and this Refund Policy.


1. SCOPE

This Refund Policy applies to all paid services offered through the DesiWay platform, including:

  • Ghar Alert apartment finder subscriptions
  • Any future paid services introduced on the platform

This policy does not apply to user-to-user transactions (marketplace purchases, accommodation deposits, AirBring arrangements, etc.), which are conducted directly between users and are outside DesiWay's control.


2. GHAR ALERT SUBSCRIPTIONS

2.1. Nature of the Service

Ghar Alert is a digital service that begins immediately upon activation. When your payment is received and matched, your subscription activates instantly and you begin receiving apartment alerts right away.

2.2. EU Right of Withdrawal (14-Day Cooling-Off Period)

Under the EU Consumer Rights Directive (2011/83/EU) and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013) (Ireland), you normally have a 14-day right to withdraw from a distance contract without giving a reason.

However, by purchasing a Ghar Alert subscription, you expressly acknowledge and agree that:

(a) The service begins immediately upon activation (payment matching).

(b) You expressly consent to the immediate performance of the service before the 14-day withdrawal period expires.

(c) You acknowledge that you lose your right of withdrawal once the digital service has been fully performed. For subscriptions shorter than 14 days (1 Day Trial, 1 Day, 3 Days, 7 Days), the service will be fully performed before the withdrawal period expires.

(d) For subscriptions of 14 days or longer (15 Days), if you exercise your right of withdrawal within 14 days of activation, you will receive a pro-rata refund for the unused portion of your subscription, minus a reasonable charge for the service already provided. The charge is calculated proportionally based on the number of full days of service used compared to the total subscription duration.

Example: If you purchase a 15 Days plan (15 days, 8.00 EUR) and withdraw after 5 days, the refund would be: 8.00 EUR - (5/15 x 8.00 EUR) = 5.33 EUR.

2.3. Refund Eligibility After the 14-Day Period

After the 14-day EU withdrawal period, refunds are generally not available because:

  • The subscription is a fixed-duration, one-time payment service
  • The service (monitoring and alerting) runs continuously from activation
  • There are no auto-renewals or recurring charges

2.4. Exceptions - When We Will Issue a Refund

Regardless of the above, we will issue a full or partial refund in the following circumstances:

(a) Service Failure: If DesiWay experiences a significant technical failure that prevents the Ghar Alert service from functioning for a material portion of your subscription period (e.g., alerts not being sent, monitoring not working), you are entitled to a pro-rata refund for the affected period.

(b) Duplicate Payment: If you accidentally make a duplicate payment for the same subscription, the duplicate amount will be refunded in full.

(c) Incorrect Amount: If you are charged more than the listed price for your plan, the difference will be refunded.

(d) Payment Not Matched: If you made a bank transfer that was not matched to a subscription (e.g., missing or incorrect reference code) and the subscription was never activated, you are entitled to a full refund.

(e) Statutory Consumer Rights: Nothing in this policy limits your statutory rights as a consumer under Irish or EU law. If you have a legal right to a refund under applicable consumer protection legislation, that right is preserved.

2.5. Free Trial

The 1 Day Trial is free of charge. No payment is required and therefore no refund applies. The trial is limited to one per account.


3. HOW TO REQUEST A REFUND

3.1. Contact Us

To request a refund, contact us within 14 days of activation (for EU withdrawal) or at any time for the exceptions listed in Section 2.4:

  • Include:
    • Your DesiWay username or registered email address
    • The reference code of your subscription (GHARXXXXXX)
    • The date and amount of your payment
    • Reason for the refund request

3.2. Processing Time

  • We will acknowledge your refund request within 3 business days.
  • Approved refunds will be processed within 14 business days of approval.
  • Refunds are issued to the original payment method (bank transfer to the account from which the payment was made).

3.3. Refund Method

Refunds are processed via bank transfer to the originating account. We may request your IBAN to process the refund if the original payment details are insufficient.


4. CANCELLATION

4.1. Subscription Cancellation

Ghar Alert subscriptions are one-time payments for a fixed duration. There is no recurring billing to cancel.

  • You cannot "cancel" an active subscription in the traditional sense, because there is no auto-renewal.
  • Your subscription simply expires at the end of the purchased duration.
  • You are not obligated to renew or purchase again.

4.2. Effect of Cancellation/Expiry

When your subscription expires:

  • You stop receiving apartment alert notifications.
  • Your alert history remains accessible in the app.
  • Your preference settings are preserved for future subscriptions.
  • No further charges are made.

5. USER-TO-USER TRANSACTIONS

DesiWay does not process payments for user-to-user transactions (marketplace, accommodation, AirBring, etc.). These transactions occur directly between users. DesiWay:

  • Does not hold funds in escrow
  • Does not mediate payment disputes
  • Does not guarantee transactions
  • Is not responsible for refunds between users

Users are responsible for negotiating refund terms directly with each other.


6. FUTURE PAID SERVICES

If DesiWay introduces additional paid services (post boosting, premium features, event ticketing, etc.), specific refund terms for those services will be communicated at the time of introduction and added to this policy.


7. COMPLAINTS AND DISPUTES

7.1. Internal Complaint

If you are dissatisfied with our response to a refund request:

8. CHANGES TO THIS POLICY

We may update this Refund Policy from time to time. Material changes will be communicated via email or in-app notification. The updated policy will be posted with a new "Last Updated" date.
