IMPORTANT LEGAL NOTICE

These Events Service Terms ("Events Terms") are Additional Terms that supplement and form part of the DesiWay Master Terms and Conditions. By using the Events Service, you agree to both the Master Terms and these Events Terms.

CRITICAL DISTINCTION - TWO TYPES OF EVENTS:

  1. Third-Party Events (User-Created Events):

    • Events created by users/third-party organizers
    • DesiWay is a platform facilitator only - NOT the event organizer
    • DesiWay assumes NO responsibility for quality, safety, legality, or fulfillment
    • All liability rests with the third-party event organizer
    • Currently, all payments occur directly between organizers and attendees off-platform
  2. DesiWay Official Events:

    • Events created and hosted by DesiWay (identified by "DesiWay Official" badge/profile)
    • DesiWay IS the event organizer and assumes full organizer responsibilities
    • DesiWay IS liable for these events as the organizer
    • Different liability and refund terms apply (see Section 1.4 and Section 11.6)

Future Payment Services: If we introduce optional payment processing services (ticketing, escrow, refunds), separate Payment Terms will apply.

1. EVENTS SERVICE OVERVIEW

1.1. Service Description

The Events Service allows users to:

  • Create and list events for the community
  • Discover events by location, date, category, and interests
  • Register for events (free and paid)
  • Receive event tickets via QR code
  • Check in to events using QR code scanning
  • Manage event registrations and attendees

1.2. Platform Role

1.2.1. Facilitator Only: DesiWay provides the platform to facilitate event listings and registrations. DesiWay is NOT:

  • An event organizer or co-organizer
  • A party to any agreements between organizers and attendees
  • Responsible for event quality, safety, or legality
  • A guarantor of event fulfillment
  • A ticketing agency (tickets are generated by organizers)

1.2.2. No Control Over Events: DesiWay does not:

  • Verify event information or organizer credentials
  • Attend or monitor events
  • Control event execution
  • Manage event operations
  • Guarantee event quality or attendance

1.3. User Agreements

For Third-Party Events: All agreements between Event Organizers and Attendees are direct agreements between users. DesiWay is not a party to these agreements.

For DesiWay Official Events: The agreement is between DesiWay (as organizer) and the Attendee.

1.4. DesiWay Official Events - Special Provisions

1.4.1. Identification: DesiWay Official Events are clearly identified by:

  • "DesiWay Official" badge or verification mark on the event listing
  • Posted from the official DesiWay account/profile
  • Labeled as "Hosted by DesiWay" in event details

1.4.2. DesiWay as Organizer: For DesiWay Official Events:

  • DesiWay acts as the event organizer
  • DesiWay is responsible for event execution, quality, and safety
  • DesiWay assumes organizer obligations under Section 5
  • DesiWay is liable as the organizer (liability limitations in Section 11.6 apply)

1.4.3. Refund Policy for DesiWay Official Events:

  • Full refunds available up to 7 days before the event
  • 50% refund available 3-7 days before the event
  • No refunds within 3 days of the event (except if event is canceled by DesiWay)
  • If DesiWay cancels an event, full refunds will be issued within 14 days

1.4.4. Quality Guarantee: DesiWay Official Events are held to higher standards:

  • Professional organization and execution
  • Compliance with all safety and legal requirements
  • Clear communication and customer service

1.4.5. Contact for DesiWay Official Events:

1.5. PLATFORM LIABILITY CLARIFICATION (DSA Article 6)

DesiWay's Role for Third-Party Events: Information society hosting service only

DesiWay operates as a hosting service under the EU Digital Services Act (DSA Article 6) for third-party user-created events. As a hosting service provider, we are not liable for user-generated content (event listings) stored at the request of users, provided we:

  • Act expeditiously to remove illegal content upon obtaining knowledge
  • Do not have actual knowledge of illegal activity or content
  • Are not actively involved in creating or controlling user content

For DesiWay Official Events:

  • DesiWay IS the event organizer
  • DesiWay DOES control and execute these events
  • DesiWay IS liable as the organizer (with limitations - see Section 11.6)

Verification Badges:

  • Indicate only user identity/account verification (for third-party organizers)
  • "DesiWay Official" badge indicates DesiWay is the organizer
  • Standard verification does NOT indicate event quality or DesiWay endorsement

1.6. LISTING RANKING PARAMETERS (P2B Regulation Article 5)

For Business Users (Professional Event Organizers, Event Companies, Venues):

The Platform to Business (P2B) Regulation requires us to explain how event listings are ranked in search results and feeds.

Main Ranking Factors:

  1. Event Date Proximity (30% influence)

    • Upcoming events ranked higher than distant events
    • Events happening soon appear near the top
    • Past events filtered out by default
  2. Location Match (25% influence)

    • Proximity to user's selected location (city/region)
    • Exact city match ranked higher than nearby cities
    • User's saved location preferences
    • Online vs. in-person event filtering
  3. Event Relevance (20% influence)

    • Match to user's community interests and preferences
    • Event category alignment with user activity
    • Event type (cultural, social, professional, etc.)
  4. Recency of Posting (15% influence)

    • Date event listing was created
    • Recent updates to event details
    • Newly posted events get visibility boost
  5. User Engagement (10% influence)

    • Number of registrations/RSVPs
    • Number of views on event
    • Number of saves/favorites
    • Social sharing activity

No Paid Promotion: Currently, DesiWay does NOT offer paid ranking boosts or sponsored placement for event listings. All events are ranked organically based on the factors above.

Future Paid Promotion: If we introduce paid promotion in the future:

  • Boosted/sponsored events will be clearly labeled as "Sponsored" or "Promoted"
  • Paid promotion will NOT replace organic ranking factors
  • Non-paying event listings will still appear in search results
  • You will be notified before any paid promotion features launch
  • All paid promotion features will be governed by our DesiWay Payment Terms and Conditions, available at desiway.in/payment-terms (when available)

Ranking Transparency: Business users (professional event organizers, event companies, venues with multiple events) can contact us for specific questions about their event visibility:

  • Include: Event ID, specific questions about ranking

How to Improve Event Visibility (Organically):

  1. Post events well in advance (more time for discovery)
  2. Upload high-quality event photos and promotional images
  3. Write detailed, accurate event descriptions
  4. Choose accurate event category and location
  5. Keep event details up-to-date
  6. Encourage early registrations (improves engagement)
  7. Verify your organizer account

Changes to Ranking: We may update ranking parameters to improve user experience. Business users will be notified of material changes to ranking criteria at least 15 days in advance via email.


2. DEFINITIONS

2.1. Events-Specific Definitions

  • "Event": Any gathering, activity, meetup, conference, workshop, concert, party, or other occasion listed on the Platform.
  • "Third-Party Event": An event created and organized by a user (not DesiWay). DesiWay acts only as a platform facilitator for these events.
  • "DesiWay Official Event": An event created, organized, and hosted by DesiWay. These events are identified by the "DesiWay Official" badge or are posted from the official DesiWay account. DesiWay acts as the event organizer for these events.
  • "Event Organizer" or "Organizer":
    • For Third-Party Events: The user who creates and lists the Event
    • For DesiWay Official Events: DesiWay (the Company)
  • "Attendee": A user who registers for an Event.
  • "Event Listing": The information posted by an Organizer describing an Event, including:
    • Event title and description
    • Date and time
    • Location (physical address or online meeting link)
    • Event type (in-person, online/virtual, hybrid)
    • Category and tags
    • Registration requirements
    • Ticket pricing (free or paid)
    • Refund policy
    • Maximum capacity
  • "Registration": The act of an Attendee signing up for an Event.
  • "Ticket": A QR code-based digital ticket generated upon successful Event registration.
  • "Check-In": The process of verifying an Attendee's ticket at the Event entrance using QR code scanning.
  • "Event Scope": Whether the Event is public (open to all), community-only (specific community), or private (invitation-only).
  • "Event Visibility": Whether the Event is visible publicly or only to specific users.

3. EVENT CREATION AND LISTINGS

3.1. Creating Events

3.1.1. Eligibility: All registered users may create Events.

3.1.2. Event Information: Event Organizers must provide accurate and complete information, including:

  • Title: Clear, descriptive event name
  • Description: Detailed explanation of the event, agenda, activities
  • Date and time: Start date/time (and end date/time if applicable)
  • Location:
    • For in-person events: Full address, venue name
    • For online events: Meeting platform and link (Zoom, Google Meet, etc.)
    • For hybrid events: Both physical location and online link
  • Event type: In-person, online, or hybrid
  • Category: Event category (e.g., social, professional, educational, cultural)
  • Event scope: Public, community-only, or private
  • Capacity: Maximum number of attendees (optional)
  • Registration requirements: Any special requirements (age restrictions, prerequisites)
  • Ticket pricing: Free or paid (with price)
  • Refund policy: Organizer's refund policy (required if paid event)
  • Images: Event photos or promotional images (optional but recommended)

3.1.3. Accurate Information: Organizers MUST provide truthful, accurate, and up-to-date Event information. Misleading or false Event listings are prohibited.

3.2. Event Listing Visibility

3.2.1. Public Events: Visible to all registered, logged-in members of the Platform. Events are NOT publicly accessible to non-registered visitors or the general public. "Public" means open to all DesiWay members, not the general internet public.

3.2.2. Community-Only Events: Visible only to members of specific communities or groups.

3.2.3. Private Events: Visible only to invited users.

3.3. Event Editing and Deletion

3.3.1. Editing: Organizers may edit Event listings at any time. Significant changes (date, time, location, pricing) should be communicated to registered Attendees.

3.3.2. Deletion: Organizers may delete Events. If an Event with registrations is deleted:

  • All registered Attendees must be notified
  • Refunds must be processed according to the stated refund policy

3.4. Event Promotion

3.4.1. Organic Promotion: Events appear in Event discovery feeds based on relevance, date, and location.

3.4.2. Paid Promotion (if available): Organizers may promote Events through paid post boosting or advertisements (subject to separate advertising terms).


4. EVENT REGISTRATION AND TICKETING

4.1. Event Registration

4.1.1. Registration Process: Attendees may register for Events by:

  • Viewing Event details
  • Clicking "Register" or "Get Ticket"
  • Providing required registration information
  • Agreeing to the Organizer's refund policy (for paid events)
  • Completing payment (for paid events)

4.1.2. Registration Confirmation: Upon successful registration, Attendees receive:

  • Email confirmation
  • In-app notification
  • Digital QR code ticket

4.1.3. Registration Data Shared with Organizer: When you register, the following information is shared with the Event Organizer:

  • Your name
  • Your email address
  • Your username and profile information
  • Registration timestamp
  • Any custom registration responses (if applicable)

4.2. QR Code Tickets

4.2.1. Ticket Generation: Upon registration, a unique QR code ticket is generated for each Attendee.

4.2.2. Ticket Access: Attendees may access their tickets via:

  • "My Events" section in the app
  • Email confirmation
  • Event detail page (if logged in)

4.2.3. Ticket Validity: Each QR code is unique and valid for single-use entry (unless the Organizer allows re-entry).

4.2.4. Ticket Transfer: Tickets are non-transferable unless the Organizer explicitly allows ticket transfers.

4.3. Event Check-In

4.3.1. QR Code Scanning: Organizers may check in Attendees by:

  • Opening the QR scanner feature in the app
  • Scanning the Attendee's QR code ticket
  • Confirming successful check-in

4.3.2. Attendance Tracking: The system records:

  • Check-in timestamp
  • Attendee information
  • Attendance status

4.3.3. Invalid Tickets: If a ticket is invalid (already used, canceled, or fraudulent), the scanner will display an error.

4.4. Event Attendance Management

4.4.1. Attendee List: Organizers may view:

  • List of registered Attendees
  • Registration details
  • Check-in status
  • Attendance statistics

4.4.2. Attendee Communication: Organizers may send announcements or updates to registered Attendees via in-app notifications or email.


5. EVENT ORGANIZER OBLIGATIONS

Event Organizers MUST:

5.1. Accurate Information

5.1.1. Truthful Listings: Provide accurate, complete, and truthful Event information.

5.1.2. Updates: Promptly update Event listings if details change (date, time, location).

5.1.3. Notify Attendees: Notify registered Attendees immediately of significant changes or cancellations.

5.2. Legal Compliance

5.2.1. Permits and Licenses: Obtain all necessary permits, licenses, and approvals required for the Event, including:

  • Venue permits
  • Alcohol licenses (if serving alcohol)
  • Music or entertainment licenses
  • Business licenses (if applicable)
  • Health and safety permits

5.2.2. Regulatory Compliance: Comply with all applicable laws and regulations, including:

  • Event safety regulations
  • Capacity limits
  • Fire safety codes
  • Accessibility requirements (ADA or equivalent)
  • Health and sanitation standards
  • Local event ordinances

5.2.3. Age Restrictions: Clearly state and enforce age restrictions (e.g., 18+, 21+ for alcohol).

5.2.4. Discrimination Prohibition: Do NOT discriminate based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics (except where legally permitted, e.g., cultural or religious events).

5.3. Event Safety

5.3.1. Safe Environment: Provide a safe environment for Attendees, including:

  • Adequate security (if needed)
  • Emergency exits and evacuation plans
  • First aid availability
  • Crowd control measures

5.3.2. Risk Assessment: Conduct risk assessments for Events with potential safety hazards.

5.3.3. Insurance: Obtain appropriate liability insurance for Events (highly recommended).

5.4. Financial Obligations

5.4.1. Honor Registrations: Honor all confirmed registrations and tickets.

5.4.2. Refund Policy: Clearly state your refund policy before Attendees register.

5.4.3. Process Refunds: Process refunds according to your stated refund policy and applicable consumer protection laws.

5.4.4. Transparent Pricing: Clearly disclose all fees, taxes, and costs before registration.

5.5. Data Protection

5.5.1. Attendee Data: Protect Attendee registration data and use it only for Event-related purposes.

5.5.2. GDPR Compliance (EU Attendees): Comply with GDPR when processing Attendee personal data, including:

  • Lawful basis for processing
  • Data minimization
  • Attendee rights (access, deletion, etc.)

5.5.3. No Misuse: Do NOT use Attendee data for spam, marketing (without consent), or sale to third parties.

5.6. Content Moderation

5.6.1. Appropriate Behavior: Ensure Event content and behavior comply with DesiWay Community Guidelines and applicable laws.

5.6.2. Remove Violators: Remove Attendees who violate Event rules or engage in prohibited behavior.


6. ATTENDEE OBLIGATIONS

Event Attendees MUST:

6.1. Accurate Registration

6.1.1. Truthful Information: Provide accurate name, email, and registration information.

6.1.2. Age Compliance: Comply with age restrictions (e.g., do not register for 21+ events if underage).

6.2. Event Rules

6.2.1. Follow Organizer Rules: Comply with Event rules, policies, and instructions from Organizers and venue staff.

6.2.2. Respectful Behavior: Treat Organizers, other Attendees, and venue staff with respect.

6.2.3. No Disruption: Do not disrupt the Event, engage in violence, or create safety hazards.

6.3. Tickets

6.3.1. Ticket Validity: Present a valid QR code ticket for entry.

6.3.2. No Fraud: Do not use fraudulent, duplicated, or invalid tickets.

6.3.3. No Ticket Scalping - Ireland Sale of Tickets Act 2021:

STRICTLY PROHIBITED - CRIMINAL OFFENSE IN IRELAND:

  • Sale of Tickets Act 2021 (Ireland): It is illegal to resell event tickets above face value in Ireland
  • Criminal Penalties: Up to €100,000 fine + up to 2 years imprisonment
  • Prohibition: You must NOT:
    • Resell tickets for profit (above face value + reasonable booking fees)
    • Use bots or automated systems to purchase tickets for resale
    • Advertise tickets for resale above face value
    • Facilitate ticket scalping on DesiWay

What IS Allowed:

  • Transferring tickets to friends/family at face value (if Organizer permits transfers)
  • Reselling at or below face value

Enforcement:

  • DesiWay will remove ticket resale listings that violate the Sale of Tickets Act 2021
  • Violations will be reported to Irish authorities
  • Accounts engaging in ticket scalping will be permanently banned

6.3.4. EU Cross-Border Ticket Resale Laws

IMPORTANT: Ticket resale laws vary significantly across EU countries.

Ireland has strict prohibitions (above), but other EU countries have different rules:

  • Some countries prohibit resale entirely
  • Some allow resale with restrictions (e.g., max % above face value)
  • Some require authorization from event organizers
  • Criminal penalties and fines vary by country

User Responsibility: If you are attending an event in another EU country or reselling tickets across borders, YOU are solely responsible for:

  • Researching and complying with the ticket resale laws in:
    • The country where the event takes place
    • Your country of residence (if different)
  • Understanding local penalties and enforcement

Official Resources:

DesiWay cannot provide legal advice on country-specific ticket laws. Consult official sources or legal professionals.

6.4. Refund Policies

6.4.1. Read Refund Policy: Review the Organizer's refund policy before registering.

6.4.2. Accept Policy: By registering, you accept the Organizer's refund policy.

6.5. Assumption of Risk

6.5.1. Event Risk: You acknowledge that attending Events carries inherent risks (injury, illness, etc.).

6.5.2. Voluntary Participation: Your attendance is voluntary, and you assume all risks.


7. EVENT PAYMENTS AND FEES

7.1. Event Pricing

7.1.1. Free Events: Organizers may create free Events with no registration fees.

7.1.2. Paid Events: Organizers may charge registration fees for Events.

7.1.3. Pricing Disclosure: All fees, taxes, and costs must be clearly disclosed before registration.

7.2. Current Status: Off-Platform Payment Processing

Currently, all event payments and ticketing occur directly between Organizers and Attendees or through external third-party processors.

7.2.1. Direct Payment Arrangements: For third-party events:

  • Organizers arrange payment processing independently (cash, bank transfer, external ticketing platforms)
  • DesiWay does NOT process or store payment card information
  • DesiWay does NOT hold funds or act as payment intermediary
  • Payment arrangements are solely between Organizers and Attendees

7.2.2. External Payment Processors: Organizers may use external payment processors (Stripe, PayPal, Eventbrite, etc.) at their own discretion. Such payments are subject to the external processor's terms.

7.3. Future Payment Services (Optional When Available)

DesiWay may introduce optional integrated payment processing services in the future, including but not limited to:

Potential Payment Features:

  • Ticketing and Registration Payments: Integrated payment processing for event tickets
  • Escrow Services: Secure holding of ticket payments until event completion
  • Refund Processing: Automated refund processing for cancellations
  • Premium Features: Subscription services for professional event organizers
  • Event Promotion Payments: Paid event boosting and advertisements

Separate Payment Terms Apply: All payments processed through DesiWay will be governed by our separate DesiWay Payment Terms and Conditions ("Payment Terms"), which will be available at:

  • URL: desiway.in/payment-terms
  • Incorporation by Reference: Payment Terms are legally binding and incorporated into these Events Terms by reference
  • Notification: Users will be notified when payment services become available

Key Points:

  • Payment services are entirely optional - organizers may continue using external payment methods
  • Payment Terms will cover: platform fees, processing fees, refunds, disputes, chargebacks, liability, payment processor relationships, and regulatory compliance
  • By using any DesiWay payment service, you agree to the Payment Terms in addition to these Events Terms
  • Payment-related liability and disputes will be governed exclusively by the Payment Terms

User Choice: Introduction of payment services does not require organizers to use them. External payment arrangements will remain permitted.

7.4. Platform Fees (When Payment Services Launch)

7.4.1. Future Fees: If/when integrated payment services launch, DesiWay may charge:

  • Platform service fees for Organizers
  • Booking fees for Attendees
  • All fees will be clearly disclosed before use

7.4.2. Current Fee Structure: No platform fees currently charged. DesiWay does not currently charge organizers or attendees any platform fees, service fees, or booking fees for using the Events Service. This may change in the future with advance notice to users.

7.5. Payment Disputes

7.5.1. User Responsibility: For off-platform payments, payment disputes must be resolved between Organizers and Attendees or with external payment processors.

7.5.2. DesiWay Not Liable: DesiWay is not responsible for payment disputes, chargebacks, or payment failures for off-platform transactions.

7.5.3. Future Payment Service Disputes: If DesiWay payment services launch, dispute resolution will be governed by the Payment Terms.


8. CANCELLATIONS AND REFUNDS

8.1. Event Cancellations

8.1.1. Organizer Cancellations: Organizers may cancel Events at any time but MUST:

  • Notify all registered Attendees immediately via email and in-app notification
  • Process refunds according to stated refund policy or applicable consumer protection laws
  • Provide explanation for cancellation (optional but recommended)

8.1.2. Force Majeure: Organizers may cancel Events due to circumstances beyond their control (natural disasters, pandemics, government orders). Refund policies apply based on Organizer's discretion and legal requirements.

8.2. Registration Cancellations

8.2.1. Attendee Cancellations: Attendees may cancel their registrations subject to the Organizer's refund policy.

8.2.2. Cancellation Process: Attendees may cancel through:

  • "My Events" section
  • Event detail page
  • Email request to Organizer

8.3. Refund Policies

8.3.1. Organizer-Defined: Each Organizer sets their own refund policy. Common policies include:

  • Full refund if canceled X days before Event
  • Partial refund if canceled within Y days of Event
  • No refunds (allowed in some jurisdictions with clear disclosure)
  • Refund only if Event is canceled by Organizer

8.3.2. Clear Disclosure: Refund policies MUST be clearly disclosed before Attendees register.

8.3.3. Consumer Protection Laws: Refund policies must comply with applicable consumer protection laws.

IMPORTANT - EU Consumer Rights Directive: Event tickets are EXEMPT from the 14-day cooling-off period (right of withdrawal) under EU Consumer Rights Directive Article 16(l). This exemption applies to tickets for:

  • Leisure events (concerts, festivals, parties)
  • Cultural events (theater, exhibitions, performances)
  • Sporting events

What This Means:

  • Attendees do NOT have an automatic right to cancel ticket purchases and receive refunds
  • Refunds are governed by the Organizer's stated refund policy
  • Organizers may offer voluntary refund policies but are not required to by EU law
  • Other consumer protection rights still apply (accurate information, fair terms, etc.)

Ireland Consumer Rights Act 2022: The above exemption also applies under Irish law. However, organizers must still comply with fair trading and consumer protection requirements.

8.4. Refund Processing

8.4.1. Organizer Responsibility: Organizers are responsible for processing refunds.

8.4.2. Refund Timeline: Refunds should be processed within 14 days (or as required by local law).

8.4.3. Payment Processor Fees: Organizers should clarify whether payment processor fees are refundable.

8.5. DesiWay's Role in Refunds

8.5.1. No Refund Obligation: DesiWay is NOT responsible for processing refunds.

8.5.2. Facilitation Only: DesiWay may facilitate communication or provide refund dispute resolution assistance at its discretion but is under no obligation to do so.


9. EVENT SAFETY AND COMPLIANCE

9.1. Organizer Safety Responsibilities

9.1.1. Venue Safety: Ensure the venue is safe, accessible, and compliant with safety regulations.

9.1.2. Emergency Plans: Have evacuation and emergency response plans.

9.1.3. Security: Provide adequate security for Events with high attendance or safety risks.

9.1.4. Health and Sanitation: Ensure compliance with health and sanitation standards (especially for food/beverage service).

9.2. COVID-19 and Health Protocols

9.2.1. Health Guidelines: Organizers MUST comply with applicable health guidelines, including COVID-19 regulations (if applicable).

9.2.2. Disclosure: Disclose any health and safety protocols (masking, vaccination requirements, etc.) in Event listings.

9.3. Accessibility

9.3.1. Accessibility Compliance: Organizers should ensure Events are accessible to individuals with disabilities (wheelchair access, accommodations, etc.).

9.3.2. Disclosure: Clearly state accessibility features or limitations in Event listings.

9.4. Alcohol and Controlled Substances

9.4.1. Legal Compliance: If serving alcohol, Organizers MUST:

  • Obtain necessary licenses
  • Verify age of attendees (21+ or legal drinking age)
  • Comply with local alcohol laws

9.4.2. Prohibited Substances: Illegal drugs and controlled substances are strictly prohibited at Events.

9.5. Photography and Recording

9.5.1. Photo/Video Disclosure: If photography or video recording will occur, disclose this in Event listings.

10. PROHIBITED EVENTS

The following types of Events are strictly prohibited on the Platform:

10.1. Illegal Activities

  • Events promoting illegal activity
  • Events violating local, national, or international laws
  • Unlicensed gambling or gaming events
  • Events involving illegal substances

10.2. Dangerous Events

  • Events posing serious safety risks without proper precautions
  • Extreme or dangerous activities without safety measures, waivers, and insurance

10.3. Discriminatory Events

  • Events promoting hate, discrimination, or violence against protected groups (except where legally permitted for cultural/religious gatherings)

10.4. Fraudulent Events

  • Fake or scam Events
  • Events with no intention of occurring
  • Events designed to collect personal information fraudulently

10.5. Adult Content Events

  • Events featuring explicit adult content, nudity, or sexual activity (unless legally permitted and age-restricted)

10.6. Multi-Level Marketing (MLM) and Pyramid Schemes

  • Events primarily promoting MLM, pyramid schemes, or high-pressure sales tactics

10.7. Political Campaign Events (Strict Compliance Required)

Political campaign and political advertising events must comply with strict legal requirements:

  • Ireland Electoral Act 1997-2024: Political advertising and campaign events must comply with Irish electoral law
  • EU Political Advertising Transparency Regulation: Transparency requirements for political advertising
  • User Responsibility: Users creating political events are solely responsible for compliance with all applicable political advertising and campaign finance laws
  • Required Disclosures: Political events must clearly identify:
    • The political party, candidate, or organization
    • Who is funding the event
    • Any required electoral registration or transparency disclosures
  • DesiWay Disclaimer: DesiWay does NOT verify, approve, or take responsibility for political event compliance
  • Penalties: Violations of electoral law can result in criminal prosecution and significant fines

If you are unsure whether your event requires compliance with political advertising laws, consult a legal professional. DesiWay cannot provide legal advice on political campaign compliance.

10.8. EU CROSS-BORDER COMPLIANCE

DesiWay operates across the European Union. Events and users may be subject to laws in multiple countries.

Multi-Jurisdictional Compliance: Users creating or attending events must comply with applicable laws in:

  1. Ireland (where DesiWay is established)
  2. The country where the event takes place
  3. The attendee's country of residence (if different)

Examples of Country-Specific Regulations:

  • Ticket resale restrictions (vary by country - see Section 6.3.4)
  • Event licensing and permits
  • Political campaign advertising laws
  • Consumer protection standards
  • Data protection requirements (GDPR applies EU-wide)

Official Resources for EU Law:

User Responsibility: DesiWay cannot monitor or advise on all national laws across 27 EU countries. Users are solely responsible for ensuring their events and activities comply with applicable national and local laws.

DesiWay's Compliance Obligation: Under the EU Digital Services Act, DesiWay will remove content deemed illegal in any EU Member State when notified by competent authorities or when we obtain knowledge of illegal activity.


11. LIABILITY AND DISCLAIMERS

CONSUMER RIGHTS PROTECTED: Nothing in these Terms excludes or limits your statutory rights as a consumer under Irish or EU law, including rights under the Consumer Rights Act 2022 (Ireland) and EU Consumer Rights Directive. You retain all legal remedies available under applicable consumer protection legislation.

11.1. DesiWay Disclaimer of Liability for Third-Party Events

FOR THIRD-PARTY EVENTS (USER-CREATED), DESIWAY IS NOT LIABLE FOR:

11.1.1. Event Quality or Fulfillment:

  • Event quality, content, or experience
  • Event cancellations or changes
  • Organizer failure to fulfill Event promises
  • Misrepresentation in Event listings

11.1.2. Safety and Injury:

  • Personal injury or harm at Events
  • Property damage at Events
  • Accidents, illness, or injury resulting from Event attendance
  • Inadequate safety measures

11.1.3. Financial Loss:

  • Loss of ticket costs due to cancellations
  • Travel or accommodation expenses
  • Refund disputes
  • Payment failures

11.1.4. Legal Issues:

  • Organizer failure to obtain permits or licenses
  • Violations of event regulations
  • Legal claims arising from Events

IMPORTANT: The above disclaimers apply ONLY to Third-Party Events. For DesiWay Official Events, see Section 11.6.

11.2. User Assumption of Risk

11.2.1. Organizer Risk: Event Organizers acknowledge and agree that:

  • They are solely responsible for their Events
  • They assume all legal, financial, and safety risks
  • DesiWay is not a co-organizer or partner

11.2.2. Attendee Risk: Event Attendees acknowledge and agree that:

  • Attending Events is voluntary
  • They assume all risks associated with Event attendance
  • They are responsible for evaluating Event safety and legitimacy

11.3. No Warranties

DesiWay provides the Events Service "AS IS" without warranties regarding:

  • Accuracy of Event information
  • Organizer reliability or trustworthiness
  • Event occurrence or quality
  • Ticket validity

11.4. Limitation of Liability (Third-Party Events)

TO THE MAXIMUM EXTENT PERMITTED BY IRISH AND EU LAW, DESIWAY DISCLAIMS ALL LIABILITY FOR ANY CLAIMS, DAMAGES, LOSSES, OR EXPENSES ARISING FROM OR RELATED TO THIRD-PARTY EVENTS (USER-CREATED EVENTS).

Legal Exclusions: This limitation of liability does NOT apply to and DesiWay cannot exclude liability for:

  • Death or personal injury caused by DesiWay's negligence or gross negligence
  • Fraud or fraudulent misrepresentation by DesiWay
  • Any liability that cannot be excluded or limited under Irish or EU law
  • Breach of statutory consumer rights under the Consumer Rights Act 2022 (Ireland) or EU Consumer Rights Directive

Scope of Disclaimer (Third-Party Events): Subject to the above legal exclusions, DesiWay is NOT liable for:

  • Event quality, content, or experience
  • Event cancellations, changes, or non-occurrence
  • Personal injury or property damage at events
  • Financial losses (tickets, travel, accommodation)
  • Organizer fraud, scams, or misrepresentation
  • Refund disputes or payment failures
  • Legal violations by event organizers
  • Indirect, consequential, or special damages

Payment Services Liability: If DesiWay introduces payment processing services in the future, liability for payment-related claims will be governed exclusively by the separate DesiWay Payment Terms and Conditions.

11.5. Third-Party Venues

DesiWay is not responsible for third-party venues, their safety, or their policies.

11.6. Liability for DesiWay Official Events

FOR DESIWAY OFFICIAL EVENTS, THE FOLLOWING TERMS APPLY:

11.6.1. DesiWay Liability as Organizer: When DesiWay hosts an Official Event, DesiWay assumes the responsibilities and liabilities of an event organizer, including:

  • Event quality and execution
  • Safety and compliance with regulations
  • Accurate event information
  • Refund processing according to stated policy (Section 1.4.3)

11.6.2. Limitation of Liability for DesiWay Official Events:

TO THE MAXIMUM EXTENT PERMITTED BY IRISH AND EU LAW:

Legal Exclusions - DesiWay CANNOT Exclude Liability For:

  • Death or personal injury caused by DesiWay's negligence or gross negligence
  • Fraud or fraudulent misrepresentation by DesiWay
  • Any liability that cannot be excluded or limited under Irish or EU law
  • Breach of statutory consumer rights under the Consumer Rights Act 2022 (Ireland) or EU Consumer Rights Directive

Scope of Liability Limitations: Subject to the above legal exclusions, for DesiWay Official Events:

  • DesiWay is NOT liable for indirect, incidental, special, consequential, or punitive damages
  • DesiWay is NOT liable for travel, accommodation, or other consequential expenses
  • DesiWay's liability for event-related issues is limited to refunding the ticket price paid

Consumer Rights Protected: Nothing in these Terms excludes or limits your statutory rights as a consumer under Irish or EU law. You retain all legal remedies available under applicable consumer protection legislation.

11.6.3. Force Majeure: DesiWay is not liable for cancellation or non-performance of DesiWay Official Events due to circumstances beyond reasonable control, including:

  • Natural disasters (earthquakes, floods, hurricanes)
  • Pandemics or public health emergencies
  • Government orders or restrictions
  • Acts of terrorism or war
  • Venue unavailability due to unforeseen circumstances

In such cases, DesiWay will provide full refunds but is not liable for travel, accommodation, or other consequential expenses.

11.6.4. Insurance: DesiWay maintains appropriate liability insurance for DesiWay Official Events. However, attendees are encouraged to obtain their own travel and event insurance.

11.6.5. Attendee Assumption of Risk: Even for DesiWay Official Events, attendees acknowledge that:

  • Event attendance carries inherent risks
  • Attendees participate voluntarily
  • Attendees are responsible for their own safety and well-being
  • DesiWay's liability is limited as stated above

11.6.6. Refunds for DesiWay Official Events: See Section 1.4.3 for the complete refund policy for DesiWay Official Events.


12. EVENT DATA AND PRIVACY

12.1. Data Sharing

12.1.1. Attendee Data Shared with Organizers: When you register for an Event, your registration data (name, email, profile) is shared with the Event Organizer.

12.1.2. Organizer Data Shared with Attendees: Organizer contact information may be visible to registered Attendees.

12.2. Data Protection Obligations

12.2.1. Organizer as Data Controller: Event Organizers act as data controllers for Attendee registration data and must comply with GDPR and applicable data protection laws.

12.2.2. DesiWay as Data Processor: DesiWay processes Attendee data on behalf of Organizers and complies with data protection laws.

12.3. Attendee Rights

Attendees have the right to:

  • Access their registration data
  • Request deletion of data from Organizers
  • Object to data processing
  • Lodge complaints with data protection authorities

FINAL ACKNOWLEDGMENT

BY USING THE EVENTS SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:

For Third-Party Events (User-Created):

  1. DesiWay is a platform facilitator and NOT an event organizer
  2. Third-party organizers are solely responsible for their events
  3. DesiWay is NOT liable for event quality, safety, cancellations, or refunds
  4. All liability rests with the third-party event organizer

For DesiWay Official Events:

  1. DesiWay IS the event organizer and assumes organizer responsibilities
  2. DesiWay IS liable as the organizer (subject to limitations in Section 11.6)
  3. Specific refund policies apply (Section 1.4.3)
  4. Higher quality standards apply

For All Events:

  1. You will comply with all applicable laws and regulations
  2. Event Organizers must honor refund policies and legal obligations
  3. Event Attendees assume inherent risks of attendance
  4. You can identify DesiWay Official Events by the "DesiWay Official" badge

If you do not agree to these terms, do not use the Events Service.
