DESIWAY - CHILD SAFETY STANDARDS

OUR COMMITMENT TO CHILD SAFETY

DesiWay is committed to creating and maintaining a safe platform that protects children and young people from exploitation, abuse, and harm. We have zero tolerance for Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM).

This document outlines our standards, reporting mechanisms, and enforcement procedures to prevent and combat child sexual abuse and exploitation on our platform.


SCOPE AND APPLICATION

These Child Safety Standards apply to:

  • All DesiWay users, content, and services
  • All platform features (Social Posts, Events, Marketplace, Accommodation, AirBring, DesiHelp Directory, DesiMeet Meetups, Messages)
  • Compliance with Google Play Child Safety Standards Policy
  • Compliance with Apple App Store Child Safety Requirements
  • Compliance with EU Digital Services Act (DSA)
  • Compliance with Irish and EU child protection laws

DEFINITIONS

Child Sexual Abuse and Exploitation (CSAE)

Any actual or attempted abuse or sexual exploitation of a child, including but not limited to:

  • Child Sexual Abuse Material (CSAM): Any visual depiction of sexually explicit conduct involving a minor (persons under 18 years)
  • Grooming: Building an emotional connection with a child to gain trust for purposes of sexual abuse or exploitation
  • Sextortion: Threatening to share sexual images/videos to coerce a child into providing more content or other demands
  • Sexual Solicitation: Requesting sexual content, contact, or acts from minors
  • Child Trafficking: Recruiting, transporting, or harboring children for exploitation
  • Sexualization of Minors: Depicting, encouraging, or promoting the sexual abuse of children

Child/Minor

Any person under 18 years of age (or the age of majority in their jurisdiction, whichever is higher).


PROHIBITED CONDUCT - ZERO TOLERANCE

DesiWay explicitly prohibits all forms of Child Sexual Abuse and Exploitation (CSAE), including but not limited to:

1. Child Sexual Abuse Material (CSAM)

  • Any visual depiction (photo, video, digital image, drawing) of minors engaged in sexually explicit conduct
  • Computer-generated images indistinguishable from real minors
  • Digitally modified, adapted, or morphed images of real children
  • Realistic depictions of a minor engaged in sexually explicit conduct
  • Self-generated CSAM (even if created by the minor themselves)

2. Grooming and Predatory Behavior

  • Attempting to establish a relationship with a minor for sexual purposes
  • Sharing sexually explicit material with minors
  • Requesting personal information from minors with intent to abuse
  • Encouraging minors to engage in sexual activity or create sexual content
  • Manipulating, coercing, or threatening minors for sexual purposes

3. Child Sexual Solicitation

  • Requesting sexual images, videos, or content from minors
  • Requesting sexual contact or meetings with minors
  • Offering money, gifts, or other incentives to minors in exchange for sexual content or contact
  • Arranging or facilitating meetings with minors for sexual purposes

4. Child Trafficking and Exploitation

  • Recruiting, advertising, or facilitating the trafficking of minors
  • Advertising or promoting commercial sexual exploitation of children
  • Facilitating child sex tourism or travel for purposes of child abuse

5. Sexualization of Minors

  • Content that sexualizes, fetishizes, or encourages the sexual abuse of children
  • Age-play or role-play depicting minors in sexual situations
  • Drawn, cartoon, anime, or simulated content depicting minors in sexual situations
  • Comments, tags, or descriptions sexualizing images of minors (even if images are non-sexual)

AGE RESTRICTIONS

Minimum Age Requirement

DesiWay requires all users to be 18 years of age or older (or the age of majority in their jurisdiction, whichever is higher).

Age Verification Measures

  • Users must declare their age during registration
  • Users must confirm they are 18+ before accessing the platform
  • Suspicious accounts claiming to be 18+ but appearing to be minors are subject to immediate investigation
  • Users who falsify their age will be permanently banned

Minor Access Prevention

  • DesiWay is not designed for use by minors
  • Parents and guardians are encouraged to use device-level parental controls (Apple Screen Time, Google Family Link, etc.)

DETECTION AND REPORTING

User Reporting Mechanism (Required by Law)

DesiWay provides an in-app reporting mechanism for users to report suspected CSAE:

How to Report:

  1. Tap the "Report" button on any post, profile, message, or listing
  2. Select "Child Exploitation" or "Illegal Activity"
  3. Provide additional details (optional but helpful)
  4. Submit report

Email Reporting:

  • Include: Content URL/location, description, username (if known)

Content Review Process

When CSAE content is reported:

  • Reports are reviewed and acted upon as soon as practicable in accordance with Irish law (Children First Act 2015). Response timeframes vary based on severity:
    • Emergency/life-threatening: Immediate escalation to An Garda Síochána
    • CSAM reports: Typically within 48-72 hours during business days
    • Other safety concerns: Within 3-5 business days
  • Reported content is analyzed for policy violations
  • Action is taken in accordance with our enforcement policy (see below)

Anonymous Reporting

Users can report anonymously through:

  • Email from anonymous email services (e.g., ProtonMail, Tutanota)
  • Direct reporting to authorities (see External Reporting below)

ENFORCEMENT AND ACTION

Actions Upon Confirmed CSAM Detection

When CSAM is confirmed after review, DesiWay takes the following actions:

1. Content Removal

  • Content immediately removed from platform
  • Content blocked from re-upload
  • No prior notification to uploader (to preserve criminal investigation)

2. Account Termination

  • Permanent ban from DesiWay platform
  • All associated accounts terminated
  • No appeals permitted for CSAM violations

3. Evidence Preservation

  • Content and metadata securely preserved for law enforcement
  • User information, IP addresses, timestamps, device information retained
  • Evidence storage complies with law enforcement requirements

4. Mandatory Reporting to Authorities (Required by Law)

Irish Authorities:

  • An Garda Síochána - Garda National Cyber Crime Bureau (GNCCB)

International Reporting:

  • Internet Watch Foundation (IWF): CSAM cases reported via secure portal
  • National Center for Missing & Exploited Children (NCMEC): Cases involving US users or US jurisdiction

Report Contents:

  • Date and time of detection/report
  • Content description (without re-sharing illegal material)
  • User information (username, email, IP address)
  • Metadata (upload timestamp, location data if available)

Actions for Other CSAE Violations

Grooming, Solicitation, or Predatory Behavior:

  • Permanent ban upon confirmation
  • Content removal
  • Reporting to law enforcement if evidence of criminal activity
  • Evidence preserved for authorities

Sexualization of Minors:

  • Permanent ban upon confirmation
  • Content removed
  • Severe cases reported to law enforcement

False Age Declaration:

  • Accounts suspected of being underage (despite 18+ declaration) are immediately suspended
  • If confirmed underage: account permanently deleted
  • If adult attempting to pose as minor: permanent ban + law enforcement notification

COOPERATION WITH LAW ENFORCEMENT

Legal Obligation to Report

DesiWay will report suspected CSAE to law enforcement authorities as required by:

  • Irish law (Child Trafficking and Pornography Act 1998)
  • EU Digital Services Act (DSA) Article 17
  • US law (18 U.S. Code § 2258A) for US users

Information Sharing with Law Enforcement

DesiWay responds to valid law enforcement requests and court orders by providing:

  • User information (username, email, registration details)
  • Content and metadata
  • IP addresses and device information
  • Communication logs (when relevant to investigation)

For child safety matters, including notifications from Google Play, Apple, or law enforcement:

Response Time:

  • CSAM reports and emergencies: Reviewed and acted upon as soon as practicable in accordance with Irish law (Children First Act 2015), typically within 48-72 hours during business days, with emergency cases escalated immediately to An Garda Síochána
  • Other child safety concerns: Without undue delay, typically within 3-5 business days, prioritized by severity
  • Law enforcement requests: Responded to as soon as practicable upon receipt, with emergency requests prioritized. We maintain a dedicated law enforcement contact email ([email protected]) and respond to valid legal requests in accordance with applicable law.

DesiWay complies with all applicable child protection laws, including:

Irish Law

  • Child Trafficking and Pornography Act 1998 (as amended)
  • Criminal Justice (Sexual Offences) Act 2017
  • Children First Act 2015

European Union Law

  • Directive 2011/93/EU on combating the sexual abuse and sexual exploitation of children and child pornography
  • EU Digital Services Act (DSA) Article 17 (Mandatory Law Enforcement Notification)
  • GDPR (child safety as lawful basis for data processing and disclosure)

International Law

  • Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography
  • Budapest Convention on Cybercrime (Council of Europe)

United States Law (for US users)

  • 18 U.S. Code § 2258A - Reporting requirements for electronic communication service providers

USER RESPONSIBILITIES

All Users Must:

  • Be 18 years of age or older to use DesiWay
  • Report suspected CSAE immediately using in-app reporting or email
  • Not download, share, or redistribute CSAM (this is illegal)
  • Not engage in grooming, solicitation, or predatory behavior
  • Not falsify age or identity

What to Do If You Encounter CSAE Content:

  1. DO NOT download, screenshot, or share the content (this is illegal)
  2. Report immediately via in-app "Report" button or email [email protected]
  3. Do not confront the user (this may interfere with law enforcement investigations)
  4. Note the username or post URL for your report

PRIVACY AND DATA PROTECTION

Disclosure to Authorities

DesiWay will disclose user information to law enforcement without user consent when:

  • CSAM is detected
  • There is suspicion of child abuse or exploitation
  • Required by law or court order
  • Necessary to protect a child from imminent harm

GDPR permits this disclosure under Article 6(1)(f) (legitimate interests) and for compliance with legal obligations.

Data Retention for Child Safety

  • CSAM evidence retained indefinitely for law enforcement
  • Banned user data retained for 7 years to prevent re-registration
  • Investigative records retained as required by law enforcement

APPEALS AND DISPUTE RESOLUTION

CSAM Violations: No Appeals

Permanent bans for CSAM violations are not subject to appeal. These decisions are final and non-reversible.

Other CSAE Violations: Limited Appeals

Users banned for other CSAE violations may submit an appeal if they believe the decision was made in error:

  3. Include: Account username, explanation, evidence
  4. Response time: 7-14 business days

Appeals are rarely successful. Decisions are final and binding.

False Reporting

Users who intentionally submit false CSAM reports to harass others will be permanently banned and may be referred to law enforcement.
