IMPORTANT LEGAL NOTICE
These AirBring Service Terms ("AirBring Terms") are Additional Terms that supplement and form part of the DesiWay Master Terms and Conditions. By using the AirBring Service, you agree to both the Master Terms and these AirBring Terms.
AirBring is a peer-to-peer connection platform for PERSONAL, NON-COMMERCIAL assistance between private individuals only. This is NOT a commercial courier, logistics, or delivery service. Currently, DesiWay does NOT transport items, provide logistics services, process payments, or guarantee delivery. All arrangements are made directly between users at their own risk. If we introduce optional payment services in the future, separate Payment Terms will apply.

1. AIRBRING SERVICE OVERVIEW
1.1. Service Description
AirBring is a platform feature that connects:
- Requesters: Users who need items delivered, purchased, or transported from one location to another
- Travelers: Users traveling between locations who offer to carry items for others
CRITICAL: NON-COMMERCIAL PERSONAL ASSISTANCE ONLY
AirBring is ONLY for personal, non-commercial assistance between private individuals (friends, family, acquaintances, community members). AirBring is NOT:
- A commercial courier service
- A commercial logistics or delivery business
- A commercial shopping or purchasing service
- A business-to-business transport service
- A regulated commercial carrier service (EU Regulation 1071/2009)
Personal Favors Only:
- Travelers may help Requesters as a personal favor
- Any compensation is personal reimbursement for expenses (fuel, time, customs duties) - NOT commercial fees
- This is peer-to-peer community assistance, NOT professional courier work
- Users must NOT operate AirBring as a business or commercial service
1.2. Platform Role
DesiWay provides the platform to facilitate connections between Requesters and Travelers. DesiWay is NOT:
- A carrier, shipper, or delivery service
- A courier or logistics company
- A party to any agreements between users
- Responsible for the transport, safety, or delivery of items
- An insurer or guarantor of transactions
1.3. User Agreements
All agreements, negotiations, and transactions occur directly between Requesters and Travelers. DesiWay is not a party to these agreements and assumes no responsibility for their performance or enforcement.
1.4. PLATFORM LIABILITY CLARIFICATION (DSA Article 6)
DesiWay's Role: Information society hosting service only
DesiWay operates as a hosting service under the EU Digital Services Act (DSA Article 6). As a hosting service provider, we are not liable for user-generated content (AirBring requests and travel plans) stored at the request of users, provided we:
- Act expeditiously to remove illegal content upon obtaining knowledge
- Do not have actual knowledge of illegal activity or content
- Are not actively involved in creating or controlling user content
Verification Badges:
- Indicate only user identity/account verification
- Do NOT indicate trustworthiness, reliability, or safety of transport arrangements
- Do NOT guarantee successful delivery or DesiWay endorsement
Critical Warning:
- Users are solely responsible for compliance with customs, aviation, and import/export laws
- DesiWay provides NO verification of item legality or safety
- Users assume ALL risks associated with item transport including legal consequences, lost/damaged items, and safety incidents
2. DEFINITIONS
2.1. AirBring-Specific Definitions
- "Requester": A user who creates a Request for item delivery, shopping, or companion services.
- "Traveler": A user who posts a Travel Plan offering to carry items during their journey.
- "Request": A listing created by a Requester specifying:
- Item description
- Origin location (from city/country)
- Destination location (to city/country)
- Request type (delivery, shopping, companion)
- Urgency level (flexible, normal, urgent)
- Item properties (fragile, perishable, liquids, medicine, prescription required)
- Category and other details
- "Travel Plan": A listing created by a Traveler specifying:
- Travel dates
- Origin location
- Destination location
- Available capacity
- Travel type (flight, train, car, bus)
- "Offer": A proposal made by a Traveler to fulfill a Request, or a proposal made by a Requester to a Traveler.
- "Item": Any physical object, good, product, or material that a Requester asks a Traveler to transport.
- "Agreement": Any arrangement, understanding, or contract between a Requester and Traveler regarding item transport, compensation, and terms.
3. SERVICE FEATURES
3.1. Requests Feature
3.1.1. Request Creation: Requesters may create Requests specifying:
- Item details (description, category, quantity)
- Origin and destination locations
- Urgency (flexible, normal, urgent)
- Request type:
- Delivery: Transport an existing item (personal favor, non-commercial)
- Shopping: Purchase and deliver an item (personal favor for friends/family ONLY - NOT commercial shopping service)
- Companion: Accompany person during travel (personal assistance only)
- Item properties:
- Fragile (handle with care)
- Perishable (time-sensitive, refrigeration may be needed)
- Liquids (subject to airline/customs restrictions)
- Medicine (requires special handling)
- Prescription required (legal documentation needed)
3.1.2. Request Visibility: Requests are visible ONLY to registered, logged-in members of the Platform. Requests are NOT publicly accessible to non-registered visitors or the general public unless the Requester deletes the Request.
3.1.3. Request Management: Requesters may:
- Edit Requests before accepting an Offer
- Delete Requests at any time
- Accept or decline Offers from Travelers
3.2. Travel Plans Feature
3.2.1. Travel Plan Creation: Travelers may create Travel Plans specifying:
- Travel dates (departure and arrival)
- Origin and destination locations
- Available capacity (e.g., "can carry up to 5 kg")
- Travel type (flight, train, car, bus)
- Additional notes
3.2.2. Travel Plan Visibility: Travel Plans are visible ONLY to registered, logged-in members of the Platform. Travel Plans are NOT publicly accessible to non-registered visitors or the general public unless the Traveler deletes the Travel Plan.
3.2.3. Travel Plan Management: Travelers may:
- Edit Travel Plans before accepting Requests
- Delete Travel Plans at any time
- Browse Requests and make Offers
3.3. Offer System
3.3.1. Making Offers:
- Travelers may make Offers on Requests
- Requesters may make Offers to Travelers based on their Travel Plans
- Offers may include proposed compensation, terms, and conditions
3.3.2. Offer Management:
- Offers Sent: View Offers you have made
- Offers Received: View Offers you have received
- Accept or decline Offers
- Negotiate terms via direct messaging
3.4. Direct Messaging
3.4.1. Private Communication: Requesters and Travelers may communicate via direct messaging to:
- Discuss item details
- Negotiate compensation
- Arrange meeting locations
- Share contact information (optional)
- Confirm delivery details
3.4.2. Communication Guidelines: All messaging must comply with DesiWay Terms and Community Guidelines. Prohibited:
- Harassment or offensive language
- Spam or unsolicited commercial messages
- Requests to move conversations off-platform for fraudulent purposes
4. USER ROLES AND RESPONSIBILITIES
4.1. Requester Obligations
Requesters MUST:
- Provide accurate information: Describe items truthfully and completely.
- Declare item properties: Accurately mark items as fragile, perishable, liquid, medicine, or requiring prescription.
- Verify legality: Ensure items are legal to transport across borders and comply with customs/import-export laws.
- Disclose prohibited items: Do NOT request transport of prohibited items (see Section 5).
- Communicate clearly: Provide all necessary information to Travelers.
- Respect Traveler agreements: Honor agreed-upon compensation and terms.
- Meet in safe locations: Arrange pickup/dropoff in public, safe locations.
- Respect Traveler time: Be punctual for agreed-upon meetings.
- Provide proper packaging: Ensure items are properly packaged to prevent damage.
- Obtain necessary documentation: Provide invoices, receipts, prescriptions, or customs forms as required by law.
4.2. Requester Representations and Warranties
By creating a Request, you represent and warrant that:
- You own or have authorization to transport the item
- The item is legal and not prohibited
- All information provided is accurate
- You will comply with all applicable laws
- You have proper documentation for the item (if required)
4.3. Traveler Obligations
Travelers MUST:
- Verify Request legality: Ensure Requests comply with airline, customs, and legal regulations before accepting.
- Refuse prohibited items: Do NOT accept Requests for prohibited or illegal items.
- Check customs regulations: Research import/export laws for origin and destination countries.
- Comply with airline rules: Follow airline baggage and carry-on restrictions.
- Handle items responsibly: Exercise reasonable care when transporting items.
- Communicate delays: Notify Requesters immediately of delays, cancellations, or issues.
- Meet in safe locations: Arrange pickup/dropoff in public, safe locations.
- Verify item against description: Inspect items before accepting to ensure they match the Request description.
- Understand customs liability: Be aware that YOU are personally and legally responsible for all items in your possession (see Section 6.2 for criminal penalties).
- Maintain communication: Keep Requesters informed of delivery status.
4.4. Traveler Representations and Warranties
By creating a Travel Plan or accepting a Request, you represent and warrant that:
- Your travel plans are accurate
- You have the legal right and capacity to transport items
- You will comply with all applicable laws and regulations
- You will exercise reasonable care in handling items
4.5. Shared User Obligations
Both Requesters and Travelers MUST:
- Act in good faith
- Communicate honestly and transparently
- Respect agreements made with other users
- Comply with all laws (local, national, international)
- Report suspicious activity or prohibited items to DesiWay
- Maintain appropriate documentation (receipts, customs forms)
- Treat other users with respect
5. PROHIBITED ITEMS AND ACTIVITIES
5.1. Strictly Prohibited Items
The following items are ABSOLUTELY PROHIBITED on AirBring and may result in immediate account termination and legal action:
5.1.1. Illegal Drugs and Controlled Substances
- Narcotics, illegal drugs, and controlled substances (unless prescribed and properly documented)
- Drug paraphernalia
- Unregulated pharmaceuticals
5.1.2. Weapons and Dangerous Materials
- Firearms, ammunition, and explosives
- Knives, bladed weapons (except as allowed by airline and customs)
- Chemical, biological, or radiological materials
- Hazardous materials (flammable, toxic, corrosive)
5.1.3. Counterfeit and Illegal Goods
- Counterfeit products (fake designer goods, forged documents)
- Stolen goods
- Items that infringe intellectual property rights
- Goods prohibited by trade sanctions or embargoes
5.1.4. Live Animals and Biological Materials
- Live animals (unless properly documented, caged, and compliant with airline/customs rules)
- Human remains or biological specimens
- Endangered species or protected wildlife products
5.1.5. Prohibited by Airlines/Customs
- Items prohibited by airline regulations
- Items prohibited by customs or import/export laws
- Items exceeding legal quantity limits (alcohol, tobacco)
5.1.6. Cash and High-Value Items (MONEY MULE RISK)
ABSOLUTELY PROHIBITED - CRIMINAL OFFENSE:
Cash:
- NEVER transport cash, gift cards, or currency for anyone
- EU legal threshold: €10,000 (must be declared; effective 2025)
- ANY amount of cash carried for strangers = Money Mule Activity
- This is how €9.4M was laundered via money mules in Ireland (2025)
- Penalties: Up to 14 years imprisonment + unlimited fines
High-Value Items:
- Large amounts of precious metals, gemstones, or jewelry without documentation
- High-value electronics without receipts or proof of ownership
- Luxury goods without verifiable purchase documentation
WARNING: If someone offers to pay you to carry cash, valuables, or "help with a package," this is likely a money laundering scheme. You will be arrested and prosecuted as a money mule. REFUSE and REPORT immediately.
5.2. Restricted Items (Allowed Only With Proper Documentation)
The following items may be allowed ONLY if users comply with all legal requirements and provide proper documentation:
5.2.1. Prescription Medications
- Requirements:
- Valid prescription from licensed physician
- Original packaging with pharmacy labels
- Letter from doctor explaining medical necessity (for international travel)
- Compliance with destination country's import laws
- Prohibited: Prescription medications without proper documentation
5.2.2. Liquids and Gels
- Requirements:
- Comply with airline liquid restrictions (typically 100ml per container, 1L total for carry-on)
- Properly packaged to prevent leaks
- Declared at security checkpoints
- Prohibited: Liquids exceeding airline limits or improperly packaged
5.2.3. Perishable Foods
- Requirements:
- Comply with customs agricultural import regulations
- Properly packaged to prevent spoilage
- Declared at customs
- Prohibited: Perishable foods banned by destination country (e.g., meat, dairy, fruits in some countries)
5.2.4. Alcohol and Tobacco
- Requirements:
- Comply with legal age restrictions
- Follow quantity limits (duty-free allowances)
- Declare at customs
- Prohibited: Quantities exceeding legal limits or transport by minors
5.3. Prohibited Activities
Users must NOT:

Money Mule Activity (CRIMINAL OFFENSE):
- NEVER carry cash, gift cards, or valuables for strangers or unknown persons
- NEVER carry sealed/closed packages without inspecting the contents inside
- NEVER transport items without seeing photos and verifying contents in person
- This is the #1 method used by organized crime to launder money
- 341 arrests for money mule activity in Ireland in H1 2025 alone
- Penalties: Up to 14 years imprisonment + unlimited fines + permanent criminal record
- If someone asks you to carry money, valuables, or sealed packages "without showing you inside" - REFUSE and REPORT

Facilitate illegal activity: Use AirBring for any illegal purpose including drug trafficking, weapons smuggling, or terrorist financing.

Violate sanctions: Transport items to or from countries under trade sanctions or embargoes.

Money laundering: Use AirBring to launder money, move illicit funds, or transfer proceeds of crime.

Human trafficking: Use AirBring to facilitate human trafficking, exploitation, or illegal immigration.

Commercial Courier Activity (PROHIBITED):
- Operating AirBring as a commercial courier, delivery, or logistics business
- Advertising professional courier services on AirBring
- Using AirBring for business-to-business (B2B) deliveries or commercial transport
- Running AirBring requests as a full-time or part-time business
- This violates EU Regulation 1071/2009 on commercial carrier licensing
- AirBring is ONLY for personal, non-commercial assistance between private individuals
6. LEGAL COMPLIANCE
6.1. User Responsibility
6.1.1. Legal Research: Users are solely responsible for researching and complying with:
- Airline baggage rules and restrictions
- Customs regulations (origin and destination countries)
- Import/export laws
- Trade sanctions and embargoes
- Tax and duty obligations
- Transportation of goods regulations
6.1.2. No Legal Advice: DesiWay does not provide legal advice. Consult legal or customs professionals if unsure.
6.2. Customs and Border Control
CRITICAL WARNING - CRIMINAL LIABILITY:
Travelers are personally and criminally liable for all items in their possession. Carrying items for others can result in:
- Criminal prosecution (up to 5 years imprisonment for serious customs violations)
- Money laundering charges (up to 14 years imprisonment + unlimited fines in Ireland)
- Seizure of items and personal belongings
- Permanent criminal record
- Travel bans and deportation
DO NOT carry items for strangers or unknown persons. This is how money mules and drug couriers are recruited.
6.2.1. Legal Responsibility: Under EU and Irish law, YOU are legally responsible for everything you carry, regardless of whether you own it or are carrying it for someone else.
6.2.2. Customs Authorities: Be aware that:
- Customs may question you about items you are carrying
- You may be required to prove ownership or authorization
- Claiming "I'm carrying this for someone else" does NOT absolve you of legal responsibility
- Be prepared to explain that you are helping someone as a personal favor (NOT operating as a commercial courier)
6.2.3. Honest Information: If questioned by customs authorities:
- Provide truthful information
- Do NOT claim items are personal belongings if they are not
- Do NOT undervalue items to evade duties
- Do NOT conceal items or provide false information
- Understand you may face criminal charges for false declarations
6.3. Aviation Security Laws
6.3.1. Airline Compliance: Users MUST comply with all airline rules, including:
- Carry-on and checked baggage restrictions
- Prohibited items lists
- Weight and size limits
- Security screening procedures
6.3.2. Security Screening: Items may be inspected by airline security. Travelers MUST be able to explain what items they are carrying and why.
6.4. Import/Export Regulations
6.4.1. Export Controls: Certain items (technology, software, controlled goods) are subject to export controls. Users MUST obtain necessary export licenses if required.
6.4.2. Import Restrictions: Many countries prohibit or restrict import of certain items (food, plants, animals, medicines). Users MUST research destination country rules.
6.5. Tax and Duty Obligations
6.5.1. Duty Payment: Travelers and Requesters are responsible for paying any customs duties, taxes, or fees on transported items.
6.5.2. Receipts and Documentation: Users should maintain receipts, invoices, and proof of value for customs purposes.
6.6. Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF)
MONEY MULE WARNING - CRIMINAL OFFENSE:
What is a Money Mule? A money mule is someone who transfers or moves illegally acquired money on behalf of criminals. This is a serious crime in Ireland and the EU.
Statistics (Ireland 2025):
- 341 arrests for money mule activity in H1 2025
- €9.4 million laundered through money mules
- Average age of arrested mules: 18-25 years
- Most common recruitment: Online platforms, social media, travel forums
How Criminals Recruit Money Mules:
- Offer to "pay you to bring a package/envelope on your trip" WITHOUT showing you what's inside
- Ask you to carry sealed/closed packages or refuse to let you inspect contents
- Request you carry cash, gift cards, or valuables for them
- Promise "easy money" for "simple favors"
- Claim items are "gifts" or "personal belongings" but won't show you
- Provide vague descriptions without photos or verification
- Target students, travelers, people needing money
- Make requests that prevent you from knowing exactly what you're carrying
Criminal Penalties (Ireland):
- Money laundering: Up to 14 years imprisonment
- Unlimited fines
- Permanent criminal record (affects employment, travel, education)
- Asset seizure (your personal money/property can be seized)
- Travel bans
AIRBRING POLICY - ZERO TOLERANCE:
6.6.1. Strictly Prohibited:
- Transporting cash, currency, or gift cards for anyone
- Carrying high-value items (jewelry, electronics, luxury goods) for strangers
- Moving money or valuables across borders for compensation
- Any activity that facilitates money laundering or terrorist financing
6.6.2. Immediate Reporting - Suspicious Activity: If someone asks you to:
- Carry cash, currency, or gift cards for them
- Transport valuables (jewelry, electronics, luxury goods) for strangers
- Carry sealed/closed packages without showing you the contents inside
- Deliver envelopes or parcels without letting you inspect what's inside
- Transport items without providing photos or allowing you to verify contents
- "Help them with a package" for easy money
- Any request that prevents you from seeing and verifying the actual item
Then REFUSE immediately and REPORT:

Legitimate AirBring Requests:
- User provides clear photos of the actual item
- You can inspect and verify the item contents in person before accepting
- Item matches the description and photos provided
- You know exactly what you are carrying
6.6.3. DesiWay Cooperation: DesiWay will:
- Report all suspected money mule activity to law enforcement
- Immediately ban users engaging in money laundering
- Cooperate fully with Gardaí and EU financial crime investigations
- Provide evidence for criminal prosecutions
6.7. EU CROSS-BORDER CUSTOMS AND TRANSPORT COMPLIANCE
DesiWay operates across the European Union. Customs, import/export, and aviation laws vary by country.
Multi-Jurisdictional Compliance: Users transporting items must comply with laws in:
- Ireland (where DesiWay is established)
- Country of departure (origin)
- Country of arrival (destination)
- Transit countries (if applicable)
Examples of Country-Specific Regulations:
- Customs duties and taxes: Different thresholds and rates per country
- Prohibited/restricted items: What's legal in one country may be illegal in another
- Medicine/pharmaceutical: Prescription requirements vary significantly
- Food/agricultural products: Import bans vary (e.g., meat/dairy banned in some countries)
- Alcohol/tobacco: Quantity limits and age restrictions differ
- Cash declaration thresholds: €10,000 EU-wide, but enforcement and penalties vary

User Responsibility: DesiWay cannot monitor or advise on all customs and transport laws across 27 EU countries. Users are solely responsible for:
- Researching customs regulations for ALL countries involved
- Understanding prohibited/restricted items in EACH country
- Declaring items honestly at customs
- Paying applicable duties and taxes
- Understanding criminal penalties for customs violations (which vary by country)
Criminal Penalties Vary:
- Customs violations can result in fines, imprisonment, deportation, or travel bans
- Penalties are determined by the country where the violation occurs
- Each country has different enforcement levels and penalties
DesiWay's Compliance Obligation: Under the EU Digital Services Act, DesiWay will remove AirBring requests/offers deemed illegal when notified by authorities.
7. SAFETY GUIDELINES
7.1. Personal Safety
7.1.1. Public Meetings: Always arrange pickup and dropoff in public, well-lit, busy locations such as:
- Airports
- Train stations
- Coffee shops
- Shopping malls
- Police stations (if safety concerns exist)
NEVER meet in:
- Private residences (unless you know and trust the person)
- Isolated or remote locations
- Late-night or secluded areas
7.1.2. Bring a Friend: Consider bringing a trusted friend or family member to meetings.
7.1.3. Trust Your Instincts: If something feels unsafe or suspicious, cancel the meeting and report the user to DesiWay.
7.2. Item Inspection
7.2.1. Inspect Before Accepting: Travelers MUST inspect items before agreeing to transport them. Check:
- Item matches description
- No signs of tampering or suspicious packaging
- Item is legal and not prohibited
- Item is properly packaged
7.2.2. Refuse Suspicious Items: If an item appears suspicious, refuse to transport it and report the Request to DesiWay.
7.2.3. Sealed/Closed Packages - PROHIBITED:
NEVER accept:
- Sealed envelopes or parcels without seeing what's inside
- Closed boxes or packages the Requester won't open for you
- Any item where you cannot personally verify the contents
- Requests without clear photos of the actual item
ALWAYS require:
- Requester must provide photos of the actual item in their AirBring request
- You must personally inspect and verify the item contents in person before accepting
- Item must match the photos and description exactly
- You must know exactly what you are carrying
This protects you from:
- Criminal liability (drugs, weapons, contraband)
- Money mule activity (cash, valuables)
- Customs violations
- Being unknowingly used for illegal activity
7.3. Documentation and Communication
7.3.1. Maintain Records: Keep records of:
- Messages exchanged with other users
- Agreements made
- Receipts, invoices, or customs forms
- Photos of items (before and after transport)
7.3.2. Written Agreements: Consider creating a written agreement with the other user specifying:
- Item description
- Compensation
- Delivery timeline
- Responsibilities of each party
7.4. Report Suspicious Activity
7.4.1. Reporting: Report the following to DesiWay immediately:
- Requests for prohibited items
- Suspicious behavior or communication
- Attempts to evade customs or laws
- Threats, harassment, or unsafe situations
7.4.2. Law Enforcement: If you suspect illegal activity, report it to local law enforcement or customs authorities.
8. PAYMENT AND COMPENSATION
8.1. Current Status: Off-Platform Transactions
Currently, all compensation and payment arrangements occur directly between Requesters and Travelers.
DesiWay currently does NOT:
- Process payments or hold funds in escrow
- Facilitate financial transactions or guarantee payment
- Mediate payment disputes
- Verify payment completion or amounts
Users are responsible for:
- Negotiating fair compensation amounts
- Agreeing on secure payment methods
- Ensuring payment is made and received
- Resolving payment disputes directly with the other party
- Complying with all applicable tax obligations
8.1.3. Future Payment Services (Optional When Available)
DesiWay may introduce optional payment processing services in the future, including but not limited to:
Potential Payment Features:
- Escrow Services: Secure holding of compensation until delivery confirmation
- Payment Processing: Transaction facilitation between Requesters and Travelers
- Dispute Resolution: Assisted dispute resolution for payment-related issues
- Insurance Options: Optional coverage for lost or damaged items
- Premium Features: Subscription services for enhanced AirBring functionality
Separate Payment Terms Apply: All payments processed through DesiWay will be governed by our separate DesiWay Payment Terms and Conditions ("Payment Terms"), which will be available at:
- URL: desiway.in/payment-terms
- Incorporation by Reference: Payment Terms are legally binding and incorporated into these AirBring Terms by reference
- Notification: Users will be notified when payment services become available
Key Points:
- Payment services are entirely optional - users may continue transacting directly off-platform
- Payment Terms will cover: fees, refunds, disputes, chargebacks, liability, payment processor relationships, and regulatory compliance
- By using any DesiWay payment service, you agree to the Payment Terms in addition to these AirBring Terms
- Payment-related liability and disputes will be governed exclusively by the Payment Terms
User Choice: Introduction of payment services does not require users to use them. Direct user-to-user transactions will remain permitted.
8.2. Payment Methods
8.2.1. User Choice: Users may agree on any payment method, including:
- Cash (in-person)
- Bank transfer
- Payment apps (Venmo, PayPal, etc.)
- Cryptocurrency (at user's own risk)
8.2.2. Secure Payment: Users are encouraged to use secure, traceable payment methods.
8.2.3. Avoid Scams: Be cautious of:
- Requests for upfront payment before meeting
- Unusual payment methods
- Requests to send money to third parties
8.3. Personal Reimbursement (Non-Commercial)
IMPORTANT: Personal Reimbursement ONLY - NOT Commercial Fees
Any compensation exchanged is personal reimbursement for expenses incurred, NOT commercial courier fees. AirBring is for personal favors between private individuals, NOT a commercial service.
8.3.1. Reimbursement Agreement: Requesters and Travelers may agree on personal reimbursement amounts. This is NOT commercial pricing - it is personal cost-sharing between individuals.
8.3.2. Reimbursement May Cover:
- Actual transportation costs (fuel, tolls, parking)
- Time and effort (as a personal favor, NOT hourly wages)
- Out-of-pocket expenses (customs duties, taxes paid on Requester's behalf)
- Shopping costs (if purchasing item for Requester)
Prohibited - Commercial Activity:
- Operating AirBring as a business or commercial courier service
- Advertising professional courier services
- Setting commercial rates or operating as a carrier for profit
- Using AirBring for business-to-business deliveries
8.4. No Guarantees
8.4.1. No Payment Guarantee: DesiWay does NOT guarantee that:
- Requesters will pay Travelers
- Payment will be made on time
- Payment disputes will be resolved
8.4.2. User Risk: Users assume all risk of non-payment or payment disputes.
9. LIABILITY AND DISCLAIMERS
CONSUMER RIGHTS PROTECTED: Nothing in these Terms excludes or limits your statutory rights as a consumer under Irish or EU law, including rights under the Consumer Rights Act 2022 (Ireland) and EU Consumer Rights Directive. You retain all legal remedies available under applicable consumer protection legislation.
9.1. DesiWay Disclaimer of Liability
DESIWAY IS NOT LIABLE FOR:
9.1.1. Item Loss, Damage, or Theft:
- Lost items
- Damaged items
- Stolen items
- Items seized by customs or law enforcement
9.1.2. Legal Issues:
- Customs violations
- Import/export violations
- Airline penalties
- Fines or legal fees
- Criminal charges arising from item transport
9.1.3. User Conduct:
- Fraud, scams, or misrepresentation by users
- Failure to deliver items
- Disputes between Requesters and Travelers
- Safety incidents during in-person meetings
9.1.4. Transactions:
- Non-payment by Requesters
- Non-delivery by Travelers
- Quality or authenticity of items
- Financial losses
9.2. User Assumption of Risk
9.2.1. Voluntary Use: You acknowledge and agree that:
- Use of AirBring is entirely voluntary
- You assume all risks associated with using AirBring
- DesiWay is not responsible for any harm, loss, or damage arising from AirBring use
9.2.2. Legal Risk: Travelers acknowledge that:
- They are legally responsible for items in their possession
- They may face legal consequences if items violate laws
- They should inspect items and verify legality before transport
9.2.3. Safety Risk: Users acknowledge that:
- In-person meetings carry inherent risks
- They are responsible for their own safety
- DesiWay does not conduct background checks or verify user identity
9.3. No Warranties
DesiWay provides AirBring "AS IS" without warranties of any kind, including:
- Accuracy of user-posted information
- Reliability or trustworthiness of users
- Successful completion of transactions
- Legality of items
9.4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY IRISH AND EU LAW, DESIWAY DISCLAIMS ALL LIABILITY FOR ANY CLAIMS, DAMAGES, LOSSES, OR EXPENSES ARISING FROM OR RELATED TO THE AIRBRING SERVICE.
Legal Exclusions: This limitation of liability does NOT apply to and DesiWay cannot exclude liability for:
- Death or personal injury caused by DesiWay's negligence or gross negligence
- Fraud or fraudulent misrepresentation by DesiWay
- Any liability that cannot be excluded or limited under Irish or EU law
- Breach of statutory consumer rights under the Consumer Rights Act 2022 (Ireland) or EU Consumer Rights Directive
Scope of Disclaimer: Subject to the above legal exclusions, DesiWay is NOT liable for:
- Lost, damaged, stolen, or seized items
- Legal consequences (customs violations, fines, criminal charges)
- Safety incidents or personal injury during user meetings
- User conduct, fraud, scams, or misrepresentation
- Non-payment, non-delivery, or failed transactions
- Quality, authenticity, or legality of items
- Indirect, consequential, or special damages
Payment Services Liability: If DesiWay introduces payment processing services in the future, liability for payment-related claims will be governed exclusively by the separate DesiWay Payment Terms and Conditions.
10. INSURANCE AND RISK
10.1. No Insurance Provided
10.1.1. DesiWay Does Not Insure: DesiWay does not provide insurance coverage for:
- Loss or damage to items
- Personal injury
- Property damage
- Legal fees or fines
10.1.2. User Responsibility: Users are solely responsible for obtaining insurance if desired.
10.2. Travel Insurance
10.2.1. Traveler Insurance: Travelers are encouraged to:
- Review their travel insurance policies
- Confirm coverage for transporting items for others
- Obtain additional insurance if needed
10.2.2. Requester Insurance: Requesters may consider:
- Insuring high-value items before transport
- Verifying coverage for international shipping or transport
10.3. Risk Management
Users should:
- Only transport low-value items
- Avoid transporting irreplaceable items
- Obtain receipts and documentation
- Take photos of items before and after transport
- Use secure packaging
11. DISPUTE RESOLUTION
11.1. User-to-User Disputes
11.1.1. Direct Resolution: Users are encouraged to resolve disputes directly through communication.
11.1.2. DesiWay Role: DesiWay is not obligated to mediate, arbitrate, or resolve disputes between users.
11.1.3. Reporting: Users may report serious disputes or violations to DesiWay for potential enforcement action.
11.2. Disputes with DesiWay
Disputes with DesiWay regarding AirBring are subject to the Dispute Resolution provisions in the Master Terms and Conditions.
12. ENFORCEMENT AND VIOLATIONS
12.1. Violation Reporting
Users must report violations of these AirBring Terms by:
- Using the in-app reporting feature
- Emailing [email protected]
- Contacting [email protected] for serious legal violations
12.2. Enforcement Actions
Violations of these AirBring Terms may result in:
- Content removal (Requests or Travel Plans)
- Account warnings
- Temporary suspension from AirBring
- Permanent account termination
- Reporting to law enforcement
12.3. Severe Violations
Severe violations (illegal items, fraud, customs evasion) will result in:
- Immediate account termination
- Reporting to law enforcement and customs authorities
- Cooperation with legal investigations

BY USING AIRBRING, YOU ACKNOWLEDGE AND AGREE THAT:
- AirBring connects users but does not provide delivery or logistics services.
- You are solely responsible for complying with all laws (airline, customs, import/export).
- You assume all risks associated with transporting or requesting items.
- DesiWay is not liable for loss, damage, legal issues, or disputes.
- You will not transport prohibited items.
- You will act honestly, safely, and in good faith.
If you do not agree to these terms, do not use AirBring.
